Under "prior appropriation" water law, older water rights get water first. Most senior rights belong to agriculture — leaving cities legally last in line. Phoenix and Las Vegas have spent billions buying farm water rights to secure their futures as populations grow.
Desalination: Mexico's Role
The U.S. and Mexico signed the Minute 323 agreement in 2017 — funding a desalination plant in Sonora to supplement Mexico's Colorado River allocation. The 2026 framework extends this cooperation, with the U.S. contributing $31.5M toward desalination capacity.
